Terms of Service.
Last updated: May 19, 2026. These terms govern your use of our website and the locksmith services we provide.
Note: These Terms apply to all visitors and customers of American Best Locksmith Inc.. If any provision conflicts with applicable law in your state of residence or where service is performed, the law controls and the rest of the Terms continue in full force and effect.
1. Service scope
American Best Locksmith Inc. provides residential, commercial, automotive, and motorcycle locksmith services. Service is provided in our four active markets: Philadelphia, PA; South Jersey / Camden, NJ; Wilmington, DE; and Houston, TX. We may decline service if a job is outside our coverage area, outside our technical capability, presents a safety risk, or if ownership cannot be verified to our reasonable satisfaction.
2. Pricing and payment
We provide upfront price quotes by phone before dispatching a technician. The quoted price is the price you pay on completion, unless the scope of work changes during service — in which case we will inform you, obtain your agreement, and document the change before continuing. Payment is due on completion of work. We accept cash, all major credit and debit cards, digital wallets (Apple Pay, Google Pay, Zelle), and business checks only — we do not accept personal checks. B2B account customers may invoice with Net 30 terms under a separate written agreement; nothing in these consumer Terms creates a B2B account.
3. Ownership verification
For all car key, motorcycle key, residential, and commercial work, we require government-issued photo identification and proof of ownership or lawful authority before performing service. Acceptable proof includes: vehicle registration; vehicle title; lease agreement; rental or rideshare-fleet authorization; insurance card with your name on it; property deed; landlord-tenant lease; or written authorization from the lawful owner. By requesting service, you represent and warrant that you have lawful authority over the vehicle, residence, or property in question. If we discover or reasonably believe ownership is misrepresented, we may stop work, refuse service, retain payment for work already performed, and report the matter to law enforcement.
4. Service hours
We offer same-day mobile dispatch during published service hours (8 AM – 8 PM, every day). We do not offer 24/7 service. After-hours and out-of-area calls are quoted individually and may not be available. We are not an emergency-services provider; if you are in a life-threatening or time-critical safety situation, contact 911.
5. Acceptable use
You agree not to: (a) request service for a vehicle, residence, or property you do not own or lawfully control; (b) misrepresent your identity, ownership, or the nature of the work needed; (c) use our services to bypass security on property you do not own; (d) reverse-engineer, scrape, or copy proprietary content from our website beyond fair use; or (e) interfere with our service operations or with other customers' service. Violation of this section terminates your right to use our services, may result in liability under state criminal law (including theft, fraud, or breaking-and-entering statutes), and obligates you to indemnify us under Section 8 below.
6. Phone calls and text messages
When you provide your phone number, you consent to receiving calls and text messages from us related to your service request, including dispatch, ETAs, completion notices, and invoices. Message and data rates may apply. You may opt out of non-essential messages by replying STOP or contacting us at service@americanbestlocksmith.com. See our Privacy Policy for details.
7. Warranty and disclaimer
Hardware we install is covered by the manufacturer's warranty as published by the manufacturer. Programming and key cutting performed by us are warrantied for ninety days from the date of service: if a key fails to function due to our cutting or programming error, we will re-cut or re-program at no charge. The warranty does not cover damage caused by misuse, abuse, modification by another party, normal wear, or events beyond our reasonable control. EXCEPT AS EXPRESSLY PROVIDED IN THIS SECTION, OUR SERVICES ARE PROVIDED "AS IS" AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. Some states do not permit the exclusion of certain implied warranties; in those states, the exclusions above apply only to the extent permitted by state law.
8. Indemnification
You agree to indemnify, defend, and hold harmless American Best Locksmith Inc., its officers, employees, and agents from and against any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of: (a) your breach of these Terms; (b) your misrepresentation of ownership or authority; (c) your misuse of our services or our work product; or (d) your violation of any law or third-party right in connection with your use of our services.
9. Limitation of liability
To the maximum extent permitted by applicable law, the total liability of American Best Locksmith Inc. for any claim arising from or related to our services or these Terms — whether in contract, tort, warranty, or otherwise — is limited to the greater of (a) the amount you paid us for the specific service giving rise to the claim, or (b) one thousand five hundred dollars ($1,500). We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of use, even if we were advised of the possibility of such damages.
The foregoing limitations do not apply to: (i) claims arising from our gross negligence or willful misconduct; (ii) bodily injury caused by our employees on your property; or (iii) liability that cannot be limited under applicable law, including under the consumer-protection statutes of Pennsylvania, New Jersey, Delaware, and Texas where such statutes apply.
10. State consumer-protection rights
Nothing in these Terms limits or waives any rights you have under the consumer-protection laws of the state where you reside or where service is performed, including but not limited to: the Pennsylvania Unfair Trade Practices and Consumer Protection Law (UTPCPL); the New Jersey Consumer Fraud Act; the Delaware Consumer Fraud Act; and the Texas Deceptive Trade Practices Act (DTPA). To the extent any provision of these Terms is unenforceable under applicable consumer-protection law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
11. Dispute resolution; arbitration; class-action waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms or the services we provide that cannot be resolved through good-faith negotiation will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Philadelphia County, Pennsylvania, before a single arbitrator. For services performed in Texas, the customer may elect to have arbitration proceed in Harris County, Texas instead of Philadelphia County, Pennsylvania — this election must be made in the customer's first written response to a notice of dispute. Either party may seek injunctive or equitable relief in court for matters involving intellectual property, trade secrets, or confidential information.
YOU AND AMERICAN BEST LOCKSMITH INC. EACH WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. Each party may bring claims only on an individual basis. The arbitrator may not consolidate claims of more than one person.
This Section does not apply where prohibited by applicable state law. Residents of states whose consumer-protection laws prohibit pre-dispute arbitration agreements retain all rights under those laws.
12. Governing law and venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except that the consumer-protection laws of the state where you reside or where service was performed continue to apply where required. The exclusive venue for any non-arbitrable dispute is the state and federal courts located in Philadelphia County, Pennsylvania, and each party consents to personal jurisdiction in those courts.
13. Force majeure
Neither party is liable for failure or delay in performance to the extent caused by events beyond its reasonable control, including: natural disasters, severe weather, pandemics, government action, labor disputes, utility failures, internet outages, or supply-chain disruptions. Affected performance obligations are suspended for the duration of the event.
14. Termination
We may decline or terminate service for any of the reasons described in Section 1 (service scope), Section 3 (ownership verification), or Section 5 (acceptable use), and for non-payment of past-due invoices. Termination does not affect rights or obligations that accrued before termination, including payment obligations for work already performed and the survival of Sections 7 (warranty), 8 (indemnification), 9 (limitation of liability), 10 (consumer-protection rights), 11 (arbitration), and 12 (governing law).
15. General
Assignment. You may not assign these Terms or transfer your rights or obligations without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of substantially all of our assets.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
Entire agreement. These Terms, together with our Privacy Policy and any written agreements we sign with you (including B2B Master Service Agreements), constitute the entire agreement between you and us regarding the services and supersede all prior or contemporaneous understandings.
No waiver. Our failure to enforce any provision is not a waiver of that provision or of any other right under these Terms.
Changes. We may update these Terms periodically. The "last updated" date reflects the most recent change. Material changes will be communicated via email (for active customers) or by prominent notice on our website.
